Firearm enhancements require increased sentence lengths for firearm use. But research shows these policies lead to\u00a0<a href=\"http:\/\/www.journals.uchicago.edu\/doi\/abs\/10.1086\/467428\">little<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.ncjrs.gov\/App\/abstractdb\/AbstractDBDetails.aspx?id=155105\">no reduction<\/a>\u00a0in crime while the longer sentences they produce\u00a0<a href=\"http:\/\/apps.urban.org\/features\/long-prison-terms\/intro.html\">contribute heavily to overcrowded prisons<\/a>.<\/p>\n<p>In Illinois, laws limit the range of sentences that judges are allowed to dispense people convicted of certain crimes. High minimums limit discretion to consider mitigating factors, such as youth or family background. When a person in Illinois commits certain felonies with a firearm, prosecutors may charge them for that firearm use. If convicted, judges are required to add 15 to 25 years to the person\u2019s sentence.<\/p>\n<p>Across the country, states are turning away from mandatory minimums and firearm enhancements. Just this year, California\u00a0<a href=\"http:\/\/www.latimes.com\/politics\/essential\/la-pol-ca-essential-politics-updates-gov-brown-gives-judges-discretion-over-1507764214-htmlstory.html\">passed a bill<\/a>\u00a0that gives judges discretion to apply the firearm enhancement, rather than making it an automatic addition. In 1998, it passed truth in sentencing laws that restricted the ability of many prisoners to earn time off their sentences. These policies have contributed to\u00a0<a href=\"http:\/\/www.icjia.state.il.us\/assets\/pdf\/ResearchReports\/FINAL%20REPORT%20The%20Impact%20of%20Illinois%20Truth-in-Sentencing%20Law%200609.pdf\">longer and longer prison stays<\/a>, while showing\u00a0<a href=\"https:\/\/www.ncjrs.gov\/App\/Publications\/abstract.aspx?ID=202746\">little to no evidence<\/a>\u00a0that the longer sentences they produce lead to safer streets and neighborhoods.<\/p>\n<p>In contrast, when done right, parole and other programs for early release both save money and reduce future crime more than incarceration.<\/p>\n<p>Parole costs the taxpayer\u00a0<a href=\"http:\/\/www.pewtrusts.org\/~\/media\/assets\/2009\/03\/02\/pspp_1in31_report_final_web_32609.pdf\">10 times less <\/a>than putting a person behind bars for the same amount of time, before taking into account the\u00a0<a href=\"https:\/\/advancingjustice.wustl.edu\/sitecollectiondocuments\/the%20economic%20burden%20of%20incarceration%20in%20the%20us.pdf\">roughly $34,000 <\/a>in annual wages individuals can\u2019t earn while incarcerated. In terms of public safety, studies also show that individuals released on discretionary parole are\u00a0<a href=\"https:\/\/www.urban.org\/sites\/default\/files\/publication\/51536\/311156-Does-Parole-Work-.PDF\">up to 16% <\/a>\u00a0Less likely to be rearrested than those released through non-discretionary programs.<\/p>\n<p>Longer sentences don\u2019t make the public any safer. Because most people who enter prison will one day be released, society is best served when time behind bars prepares these individuals to live responsibly once returned.<\/p>\n<p>Some believe harsh and degrading prison conditions help curb criminal behavior through deterrence and subjugation. But research shows that these harsh conditions\u00a0<a href=\"http:\/\/www.anderson.ucla.edu\/faculty\/keith.chen\/papers\/Final_ALER07.pdf\">don\u2019t reduce recidivism<\/a>, and can\u00a0<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=1443093\">actually have the opposite effect<\/a>.<\/p>\n<p>In recent years, the Illinois Department of Corrections has been sued across <a href=\"http:\/\/redesign.uplcchicago.org\/lawsuits\/\">multiple class action suits<\/a>, on issues ranging from\u00a0<a href=\"https:\/\/www.aclu-il.org\/en\/cases\/lippert-v-godinez\">inadequate medical care<\/a>\u00a0to\u00a0<a href=\"https:\/\/dockets.justia.com\/docket\/illinois\/ilsdce\/3:2015cv00309\/70322\/\">physical and sexual abuse<\/a>\u00a0at the hands of militarized tactical squads. These suits point to the degrading and potentially criminal conditions in correctional facilities, that may end up costing taxpayers\u00a0<a href=\"https:\/\/www.loevy.com\/consistent-impacts\/60-million-strip-search-settlements-cook-county-jail-prisoners\/\">millions<\/a>\u00a0in payouts and settlements.<\/p>\n<p>So what should we do instead? Investing in prison\u00a0<a href=\"https:\/\/eric.ed.gov\/?id=EJ740028\">programming shown to reduce recidivism<\/a>\u00a0is one way to make prisons a pathway to rehabilitation, rather than an anchor that drags and keeps people down. Supporting\u00a0<a href=\"https:\/\/urbanlabs.uchicago.edu\/attachments\/store\/c8bc3243fec2e340e8a419e67c3a788ab8c54d6d40bd7cc9cb2d2fe39e53\/20170623+OSC%2B2013+Policy+Brief+FINAL.pdf\">programs that divert at-risk youth<\/a>\u00a0from criminal activity before they ever enter is another. And while some of the policies this era produced have had modest impacts on crime rate, they came at the cost of making Illinois\u2019 prison system the <a href=\"https:\/\/www.illinoispolicy.org\/illinois-leads-nation-in-overcrowded-prisons\/\">most overcrowded in the nation<\/a>.<\/p>\n<p>These laws need reform, and in some cases repeal. And to really impact prison crowding, these reforms must apply retroactively. Firearm enhancements require increased sentence lengths for firearm use. But research shows these policies lead to\u00a0<a href=\"http:\/\/www.journals.uchicago.edu\/doi\/abs\/10.1086\/467428\">little<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.ncjrs.gov\/App\/abstractdb\/AbstractDBDetails.aspx?id=155105\">no reduction<\/a>\u00a0in crime while the longer sentences they produce\u00a0<a href=\"http:\/\/apps.urban.org\/features\/long-prison-terms\/intro.html\">contribute heavily to overcrowded prisons<\/a>.<\/p>\n<p>In Illinois, laws limit the range of sentences that judges are allowed to dispense people convicted of certain crimes. High minimums limit discretion to consider mitigating factors, such as youth or family background. When a person in Illinois commits certain felonies with a firearm, prosecutors may charge them for that firearm use. If convicted, judges are required to add 15 to 25 years to the person\u2019s sentence.<\/p>\n<p>Across the country, states are turning away from mandatory minimums and firearm enhancements. Just this year, California\u00a0<a href=\"http:\/\/www.latimes.com\/politics\/essential\/la-pol-ca-essential-politics-updates-gov-brown-gives-judges-discretion-over-1507764214-htmlstory.html\">passed a bill<\/a>\u00a0that gives judges discretion to apply the firearm enhancement, rather than making it an automatic addition. And since 2000,\u00a0<a href=\"https:\/\/storage.googleapis.com\/vera-web-assets\/downloads\/Publications\/playbook-for-change-states-reconsider-mandatory-sentences\/legacy_downloads\/mandatory-sentences-policy-report-v3.pdf\">at least seventeen states <\/a>from across the political spectrum have rolled back mandatory minimums.<\/p>\n\n                                    <\/div>\n                                \n                                \n                                                            <\/div>\n                                                    \n                            <div\n                            class=\"relative overflow-hidden transition-all max-h-0 duration-500\"\n                            x-ref=\"container2\"\n                            :style=\"activeTab == 2 ? In 1998, it passed truth in sentencing laws that restricted the ability of many prisoners to earn time off their sentences. These policies have contributed to\u00a0<a href=\"http:\/\/www.icjia.state.il.us\/assets\/pdf\/ResearchReports\/FINAL%20REPORT%20The%20Impact%20of%20Illinois%20Truth-in-Sentencing%20Law%200609.pdf\">longer and longer prison stays<\/a>, while showing\u00a0<a href=\"https:\/\/www.ncjrs.gov\/App\/Publications\/abstract.aspx?ID=202746\">little to no evidence<\/a>\u00a0that the longer sentences they produce lead to safer streets and neighborhoods.<\/p>\n<p>In contrast, when done right, parole and other programs for early release both save money and reduce future crime more than incarceration.<\/p>\n<p>Parole costs the taxpayer\u00a0<a href=\"http:\/\/www.pewtrusts.org\/~\/media\/assets\/2009\/03\/02\/pspp_1in31_report_final_web_32609.pdf\">10 times less <\/a>than putting a person behind bars for the same amount of time, before taking into account the\u00a0<a href=\"https:\/\/advancingjustice.wustl.edu\/sitecollectiondocuments\/the%20economic%20burden%20of%20incarceration%20in%20the%20us.pdf\">roughly $34,000 <\/a>in annual wages individuals can\u2019t earn while incarcerated. In terms of public safety, studies also show that individuals released on discretionary parole are\u00a0<a href=\"https:\/\/www.urban.org\/sites\/default\/files\/publication\/51536\/311156-Does-Parole-Work-.PDF\">up to 16% <\/a>\u00a0Less likely to be rearrested than those released through non-discretionary programs.<\/p>\n<p>Longer sentences don\u2019t make the public any safer. Because most people who enter prison will one day be released, society is best served when time behind bars prepares these individuals to live responsibly once returned.<\/p>\n<p>Some believe harsh and degrading prison conditions help curb criminal behavior through deterrence and subjugation. But research shows that these harsh conditions\u00a0<a href=\"http:\/\/www.anderson.ucla.edu\/faculty\/keith.chen\/papers\/Final_ALER07.pdf\">don\u2019t reduce recidivism<\/a>, and can\u00a0<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=1443093\">actually have the opposite effect<\/a>.<\/p>\n<p>In recent years, the Illinois Department of Corrections has been sued across <a href=\"http:\/\/redesign.uplcchicago.org\/lawsuits\/\">multiple class action suits<\/a>, on issues ranging from\u00a0<a href=\"https:\/\/www.aclu-il.org\/en\/cases\/lippert-v-godinez\">inadequate medical care<\/a>\u00a0to\u00a0<a href=\"https:\/\/dockets.justia.com\/docket\/illinois\/ilsdce\/3:2015cv00309\/70322\/\">physical and sexual abuse<\/a>\u00a0at the hands of militarized tactical squads. These suits point to the degrading and potentially criminal conditions in correctional facilities, that may end up costing taxpayers\u00a0<a href=\"https:\/\/www.loevy.com\/consistent-impacts\/60-million-strip-search-settlements-cook-county-jail-prisoners\/\">millions<\/a>\u00a0in payouts and settlements.<\/p>\n<p>So what should we do instead? Investing in prison\u00a0<a href=\"https:\/\/eric.ed.gov\/?id=EJ740028\">programming shown to reduce recidivism<\/a>\u00a0is one way to make prisons a pathway to rehabilitation, rather than an anchor that drags and keeps people down. Supporting\u00a0<a href=\"https:\/\/urbanlabs.uchicago.edu\/attachments\/store\/c8bc3243fec2e340e8a419e67c3a788ab8c54d6d40bd7cc9cb2d2fe39e53\/20170623+OSC%2B2013+Policy+Brief+FINAL.pdf\">programs that divert at-risk youth<\/a>\u00a0from criminal activity before they ever enter is another. And while some of the policies this era produced have had modest impacts on crime rate, they came at the cost of making Illinois\u2019 prison system the <a href=\"https:\/\/www.illinoispolicy.org\/illinois-leads-nation-in-overcrowded-prisons\/\">most overcrowded in the nation<\/a>.<\/p>\n<p>These laws need reform, and in some cases repeal. And to really impact prison crowding, these reforms must apply retroactively.
