Roper v. Simmons (March 2005) <\/h3>\n \n \n

The Court held the death penalty for individuals younger than 18 is cruel and unusual punishment under the Eighth Amendment. The death penalty is reserved for individuals who commit the most serious crimes \u201cand whose extreme culpability makes them the most deserving of execution.\u201d Because of the differences between children and adults, the court held \u201cjuvenile offenders cannot with reliability be classified among the worst offenders.\u201d In particular, youth lack maturity and have \u201can underdeveloped sense of responsibility,\u201d they are \u201cmore vulnerable or susceptible to negative influences and outside pressures, including peer pressure.\u201d These differences lower a child\u2019s culpability and \u201crender suspect any conclusion that a juvenile falls among the worst offenders.\u201d<\/p>\n
